â€Å"The tree of liberty must be refreshed from time to time with the blood of patriots and tyrants.† Thomas Jefferson is arguably one of the most influential people to Virginia and the United States before and during the American Revolution. Jefferson had been a governor for Virginia during the American Revolution, he had wrote the Declaration of Independence along with four other notable American politicians, and served as a minister to France in 1785-1789. Without Jefferson the American Revolution most likely would have played out completely different and we could possibly be living a different life today. Thomas Jefferson was born on April 13th, 1743 in Albemarle County, Virginia into a family of wealth. King George had not helped the 13 colonies in any way and really only used them to gain wealth for Great Britain and himself. George’s method of gaining wealth from the 13 colonies was that they could only trade to Great Britain, which did not help the 13 colonies expand as a country. Also, he heavily taxed colonists on the western hemisphere because he needed aid to pay off his former war debts. The colonists were not happy about his acts because it gave them little opportunity of expanding their wealth or fortune which, is the main idea of coming to the â€Å"New World.† This made colonists very angry now was thickening the hatred for their leader they were now just as mot ivated as the politicians; resulting in, plenty of change, leading to the American Revolution. Genghis Khan a tyrant and a bloodthirsty villain during his period he conquered more territory than any other leader in history. Julius Caesar a great general that ever lived, he also knew how to elevate money for festivals and gifts. Lastly, Alexander the Great is a person who conquered many territories, had a large empire, formed the Hellenistic culture, and became very successful. Corruption in Annawadi Essay With depressive emotion, I finish reading the book Behind the Beautiful Forevers by Katherine Boo. The book talking about Husain familys story and other people in the slum in Mumbai. Everyone seeks opportunity to make money. Though everyone is poor, the poor people bully the poorer people. Life, death, and hope in a Mumbai undercity is the subtitle of the book, but I think there is another keyword for the subtitle corruption. Corruption is a big issue in Annawadi, and it is the main reason to cause the society and economy cannot improve. In other words, corruption makes the wealth inequality worse. Although, corruption in short-term can help people to make money, in long-term corruption increasing the gap between poor and rich people, and keep the whole society from improving. In short-term, people bribe, manipulate, lie, cheat, and sell themselves in order to make money. However, in the long-term, people make money is hard, but money make money is fast. For instance, the process Sunil makes money is very difficult he could not solve the food problem. Then, Sunil sells the pot and his fathers shoes to learn to make money. This process is long and hard. On the contrary, Asha, for example, she can get money easily in many corruptive ways. She knows that people like to ask her for help, and she helps them only when she can get financial profit. Therefore, she sometimes makes problems for people and then waiting for people to ask her for help in order to get money. Thus, the poor people become more and more poor, and rich people become more and more rich. However, corruption limits security, stability, dignity, and even life of people in Annawadi. According to the Universal Declaration of Human Right, Article 25 Everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food, clothing, housing and medical care and necessary social services, and the right to security in the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond his control. We know that health care is required for people. People need to be strong and healthy to go to work. Otherwise, they cannot make money and fend their family, or even being tortured by sick. According to the book, Mumbais public hospitals were supposed to do such operations for next to nothing, but the hospital surgeons wanted under-the-table money. Sixty thousand rupees, said the surgeon at Sion Hospital. The doctor at cooper Hospital wanted more. (24) The surgeons get under-the-table money corruptly cause the cheap fee raised up so that so many patients cannot have treatment. Corruption makes the community dark. All the thing that people care about is money and themselves. People who give doctor and under-the-table money can become healthy and strong then go to work to make money, and people who cannot afford it lost job and waiting for death. Therefore, the wealth gap become larger and larger. Education also makes this issue worse. To better the country, the government need to focus on health care and education. People need have a closer relationship, to help others, to share.

The Waste Land Essay -- Literary Analysis, T.S. Eliot

Faulkner presents sexual desire in The Sound and the Fury as a paradox of both entrapment and freedom. As he works his way through the nonlinear piece, information about sexuality of the characters, sexual symbols, and unfilled desire present themselves, each commenting on one another directly and indirectly. T. S. Eliot’s â€Å"The Waste Land† serves as a helpful lens in understanding the requirements to escape the waste land of the ruined Compson family by providing a backdrop on which The Sound and the Fury can be projected. In The Sound and the Fury, Faulkner experiments with the placement of the individual in respect to time and other characters in order to introduce sexual discourse in a way that comments on the necessity of sexual understanding in the modern world. T.S. Eliot’s â€Å"The Waste Land† offers an interpretation of the modern world that on one hand underscores the disillusionment of the future in a world that is fragmented and bare, and on the other hand, presents a case for recognizing freedom and meaning in the â€Å"heap of broken images† that make up the modern climate. The opening segment â€Å"The Burial of the Dead† looks toward a future that is composed of fragments and paradox. The fragments in the waste land that is presented are that of memory. More specifically, the fragments represent a failure in the human condition to connect memories of the past to those of the present in a way that is hopeful and inspiring. Jewel Spears Brooker and Joseph Bentley present this concept in Reading the Waste Land: Modernism and the Limits of Interpretation. Here they describe a waste land in which â€Å"She [Marie] perceives the dualistic and paradoxical present as cruel because, in remembering the past and intuiting the future, sh... ...cter’s sexual desires but rather puts forth bits of imagery to suggest a meaning. This allows for the reader to interpret which version of sexual desire is the best. In a way, the text offers as many interpretations of sexuality in the modern sense as there are readers since the source of sexual desire is not always clearly stated. Faulkner implements in this way a circular logic to understand sexuality in the modern world, it is the cause of moral decay in the modern world, yet sexual desire is born out of the need to piece together the modern world in some way. Ultimately, one can read The Sound and the Fury through the lens of Eliot’s â€Å"The Waste Land† to gather the importance of hanging on to just enough of the past while surging toward the future, allowing desires to take hold and guide the characters to a destination that offers insight into one’s self.

In Fitness Gym, recording details are written down on record books. A record book is a compilation of the known facts regarding something or someonewith their personal information provided. It is also organized for use and maintained by an employee, or a private individual. In addition, it is a place in which we get information in any format and from many sources. The employee has to keep the room neat so that it is conductive the fitness activity. The gym employee is also the person who is liable for monitoring all the records in the said establishment. The proponent will propose a computerized recording system for the FEM GYM. The gym is still utilizing a manual system. The costumers and the employees still use a logbook in writing down the information and records of each client. This system is to provide facilities for users to enter information into the system  directly, instead of passing the information usually on paper. Objectives of the Study General Objective Generally, the proponent’s purpose in designing the system is to help the operation of FEM Fitness Gym with regards to their records. This system will be able to help the said establishment to find their records accurate and promptly. Also to change the manual system of their daily recording. Chapter 3 Research Methodology Descriptive Method It was argued that archival description is not simply an aid to discovery and retrieval3. Instead, it is integral to documenting knowledge about records and the circumstances in which they are made and kept – essential knowledge  for the records to exist as records and serve their principal use as evidence. In other words, the primary purpose of documentation or finding aids is not repository control or the facilitation of access but as an indispensable component in the making and keeping of records. In the paper world, it was possible to lose sight of this because archival methods based on the ‘life cycle’ separated the preparation of finding aids in time from other documentation activities. Archivists acquired custody of records no longer in current use and preserved them by physically segregating them into provenance-based fonds in an order reflecting their last practical use. This fixity of placement and arrangement was replicated in finding aids which did l ittle more than represent the physical organisation of the records in boxes and on shelves. In this last ‘archival’ phase of the life cycle, such finding aids contribute little to recordkeeping (merely duplicating physical placement, which has been the chief recordkeeping tool known to the archivist). Consideration is the essential element Essay

Introduction 1 According to Lord Pollock’s definition of consideration which is an act or forbearance of one party, or the promise thereof, is the price for which the promise of the other is bought and the promise thus given for value is enforceable.2 Besides that, consideration must be something of value given or promised in exchange for the promise given by the other party in order for a valid contract to be formed.3 The term â€Å"something of value† can be defined as a payment, an act or services, an object or giving up legal right. There are certain rules of consideration that have been established in the precedent case. The first rule of consideration is it will only exist when a contract is to be enforceable.4 Secondly, a good consideration can be done in the present and future but not the past.5 A consideration can be done even though the promisor has no knowledge of it.6 The fourth rule of consideration is it does not have to be adequate or commercially realistic.7 Also, consideration must be tangible and cannot be too vague. 8 Lastly, consideration must be legally sufficient in the eye of the law.9 The objective of this research essay is to discuss and explain the rule of the consideration which is consideration does not have to be adequate or commercially realistic but it has to be sufficient and how these legal concepts relate to the cases. Thus, this research essay also discusses whether Australia contract law should provide greater clarity about what is sufficient consideration. He called his executor and requested that when he died his wife could live in his house until her demise. The executor agreed and later drew up an agreement with  the Thomas’s wife. Consideration must be tangible This is another rule of consideration where it must not be too vague or indefinite.17 Consideration must be tangible but not nebulous.18 This has been shown in the case of White v Bluett.19 In White v Bluett, a son  borrowed money from his father and signed a â€Å"promissory note† to prove the debt. He notices that similar loans were made by his father to his brother without a note having been signed. He harassed his father, and his father told him that he would forgive the repayment of debt if the son ceases the harassment. After the father died, the administrator of the estate found out the note and sued the son but the son argued that the debt had been forgiven in consideration of his undertaking to cease harassment. The court held that there is no consideration as the promise was too vague to have legally recognized value. From the case of White v Bluett, it shown that if a promise is relied on as consideration is too vague and indefinite that the courts will not enforced it and it will not constitute consideration.20 Consideration must be Legally Sufficient This rule simply mean that consideration must be sufficient and it must have a legally value recognised value.21 Thus, a mere moral obligation or the natural love and affection do not deliver sufficient consideration.22 This has been shown in the case of Eastwood v Kenyon.23 In this case, as a guardian, Eastwood had incurred many expenses for the girl. 24 As an adult, the girl and her husband Kenyon promised to pay Eastwood.25 At the end, they refuse to pay back then Kenyon was sued upon this promise. Therefore, the situation show that such a moral obligation is not a consideration.26 Besides that, in general rule a promise to perform an existing obligation is not a sufficient consideration as it promises no more than what that party already bound to do.27The rule expresses the concept of illusory consideration. Thus, when there is a promise not to sue, or when there is an abandon to a claim, it can be a sufficient consideration. This has been shown in the case of Wigan v Edward28. Where the court decision is that, given that the buyer honestly believed that they do not need to settle unless he rectified the defects, the compromise of that belief provided good consideration for the builder’s promise.29 Furthermore, performing an obligation under a pre-existing contract is not a good consideration for a new promise for extra payment unless the performance of the obligation requires additional tasks to be completed or  involves providing additional practical benefit to the promisor.30 The additional practical benefit is an exception to the rule that a promise to carry out a pre-existing duty may create valid consideration. This has been show in the case of Williams v Roffey Bros & Nicholls (Contractors).31 In Williams v Roffey Bros & Nicholls, Roffey were a firm of builders contracted to renovate a block of flats. Their own contract contained a penalty clause for late completion, so it was in their interest to finish the work in time. Part of this work they sub-contracted to Williams. As work progressed, Williams fell behind schedule because, they claimed, they had not set an adequate price for the work. They negotiated a new deal with Roffey that an additional sum was to be pay on the completion of each building. When the next building was complete, Roffey refused to pay. The court held that, there was consideration in this case as the new agreement conferred additional practical benefit on Roffey, in particular an early completion would allow them to avoid the exercise of the penalty clause. As we can see from the case of Williams v Roffey Bros & Nicholls, a promise to perform an existing contractual duty does not provide valuable consideration but the case show that Roffey had provide additional practical benefit and then consideration exist. Conclusion In conclusion, consideration must be of sufficient value in the eye of law and it must be something that identifiable and tangible. Thus, it does not have to be commercially adequate to the promise as the parties are free to make their own bargains and the court will not get involve into the commercial adequacy.32 Therefore, Australia Contract Law should not provide greater clarity as it is a sufficient consideration.

The Doomed Journey of Panfilo de Narvaez in Florida Panfilo de Narvaez (1470-1528) was born to an upper-class family in Vallenda, Spain. Although he was older than most Spaniards who sought their fortunes in the New World, he nevertheless was extremely active in the early conquest period. He was an important figure in the conquests of Jamaica and Cuba in the years between 1509 and 1512. He acquired a reputation for ruthlessness; Bartolome de Las Casas, who was a chaplain on the Cuba campaign, recounted horrible tales of massacres and chiefs being burned alive. In Pursuit of Cortes In 1518, the governor of Cuba, Diego Velazquez, had sent the young conquistador Hernan Cortes off to Mexico to begin the conquest of the mainland. Velazquez soon regretted his actions, however, and decided to place someone else in charge. He sent Narvaez, with a large force of more than 1,000 Spanish soldiers, to Mexico to take command of the expedition and send Cortes back to Cuba. Cortes, who was in the process of defeating the Aztec Empire, had to leave the recently subdued capital of Tenochtitlan to return to the coast to fight Narvaez. The Battle of Cempoala On May 28, 1520, the forces of the two conquistadores clashed at Cempoala, near present-day Veracruz, and Cortes won. Many of Narvaez’s soldiers deserted before and after the battle, joining Cortes. Narvaez himself was jailed in the port of Veracruz for the next two years, while Cortes retained control of the expedition and the vast wealth that came with it. A New Expedition Narvaez returned to Spain after being released. Convinced that there were more wealthy empires like the Aztecs to the north, he mounted an expedition that was doomed to become one of the most monumental failures in history. Narvaez got permission from King Charles V of Spain to mount an expedition into Florida. He set sail in April 1527 with five ships and about 600 Spanish soldiers and adventurers. Word of the riches earned by Cortes and his men made finding volunteers easy. In April 1528, the expedition landed in Florida, near present-day Tampa Bay. By then, many of the soldiers had deserted, and only about 300 men remained. Narvaez in Florida Narvaez and his men clumsily made their way inland, attacking every tribe they met. The expedition had brought insufficient supplies and survived by pillaging meager Native American storehouses, which caused violent retaliation. The conditions and lack of food caused many in the company to become ill, and within a few weeks, a third of the members of the expedition were severely incapacitated. The going was tough because Florida was then full of rivers, swamps, and forests. The Spanish were killed and picked off by irate natives, and Narvaez made a series of tactical blunders, including frequently dividing his forces and never seeking allies. The Mission Fails The men were dying, picked off individually and in small groups by native attacks. Supplies had run out, and the expedition had alienated every native tribe it had encountered. With no hope to establish any sort of settlement and with no help coming, Narvaez decided to abort the mission and return to Cuba. He had lost touch with his ships and ordered the construction of four large rafts. The Death of Panfilo de Narvaez It is not known for certain where and when Narvaez died. The last man to see Narvaez alive and tell of it was Alvar Nunez Cabeza de Vaca, a junior officer of the expedition. He recounted that in their final conversation, he asked Narvaez for help the men on Narvaezs raft were better fed and stronger than those with Cabeza de Vaca. Narvaez refused, basically saying â€Å"every man for himself,† according to Cabeza de Vaca. The rafts were wrecked in a storm and only 80 men survived the sinking of the rafts; Narvaez was not among them. The Aftermath of the Narvaez Expedition The first major incursion into present-day Florida was a complete fiasco. Of the 300 men who landed with Narvaez, only four ultimately survived. Among them was Cabeza de Vaca, the junior officer who had asked for help but received none. After his raft sunk, Cabeza de Vaca was enslaved by a local tribe for several years somewhere along the Gulf Coast. He managed to escape and meet up with three other survivors, and together the four of them returned overland to Mexico, arriving some eight years after the expedition landed in Florida. The animosity caused by the Narvaez expedition was such that it took the Spanish years to establish a settlement in Florida. Narvaez has gone down in history as one of the most ruthless yet incompetent conquistadors of the colonial era.

Similar notion has been made by James, Charles and Catherine (1998). They maintain that women have the ability to be considered more likeable than men; though this is a feature which is generally distributed among both men and women. Many of the profession progressing strategies demand for developing relationships with others. Regardless of the sexuality, an individual who is not graded high on the personality measure of likeability would have comparatively lesser likelihood of developing and maintaining relationships with the others. Contrarily, individuals with likeable personalities would have more opportunities to pursue career progressing strategies, entailing relationship building and socializing. Gender discrimination frequently can be seen in different organizations. Most of the organizations are suffering from such problem of discrimination related to gender. Though there are different laws and polices developed by different countries about gender discrimination. But there is no implication of these laws in real context. Women perceived that they are not rated in a justified manner related to training, appraisals, and career development opportunities as compare to men (Blau, 1998; Blau, Ferber, Winkler, 1998). Societal trends Gretchen Courtney (2009) are more concerned with the source of discrimination. They maintain that the responses of men and women for inquiries pertaining to sexual partiality may differ. Their responses will be subjected to whether the source of biasness is an individual or a policy decision / rule. Researchers have established that victims of gender partiality are mostly compulsive or reluctant to highlight the sexual inequality they experience at workplace. This elucidates that one of the prime reason for presence of gender discrimination is the tendency of individuals not to surface the practice of sexual discrimination. Consequently, the individuals inability to report this kind of discrimination is more pronounced in countries like Pakistan; whereby, human resource (females in particular) is comparatively less vocal. Furthermore, sexual favoritism at workplace may give birth to gender discrimination, affecting the workforce in terms of career (progression) opportunities. Antecolet. (2009) is of the point of view that both men and women are dissatisfied with their jobs who experience gender discrimination at workplace. Though according to the results, employment status of male employees is significantly connected to their marital status. On the other hand, employment status of the female is significantly subjected to their performance and productivity. Females are not discriminated on the basis of conscious decision of the management but most of the time management have some precautions about hiring of females for highly responsible posts because it is a general assumption about women that they are to fulfill their family obligations, so they are not suitable for vital designation of organizations (Crompton Birkelund, 2000; Glass, 2000; Waldfogel, 1998). Gender discrimination is not specific for female but often males are also victims of gender discrimination. It depends on the marital status, married males have more chances of getting jobs rather than females. On the other hand, unmarried females have more chances of being selected by the organization than unmarried males (Petersen Togstad, 2006). Sexual favoritism and gender partiality Sexual favoritism and gender partiality / discrimination are often similarly perceived. However, Glenn, James M., James F (2006) have befittingly differentiated the two. They delineate that sexual favoritism entangles the discerning grant of a gain or opportunity at the workplace; in contrast, sexual partiality / discrimination usually involves the restraining of benefits or opportunities dependent upon an individuals gender. Gender bias during career progression In broader concept, gender segregation does not mean segregation in terms of gender but it means segregation in terms of incentive for performance. The connotation is that sexual discrimination is not associated to the recruitment process alone; in fact, it continues across the entire professional careers of individuals. Effects of sexual biasness Stephan, Johan, Karen (2012) have explained discrimination as the prejudicial handling of individuals. Generally, it is based on association with a certain division or group. Because of discrimination, there is a likelihood of negative effects on the employees productivity, well-being and health. They have also mentioned various grounds of workplace discrimination by calling it a systematic refusal of employees rights based upon their ethnic affiliation, religion, age, sexual preferences, gender, or other criteria. These bases for sexual partiality may consequently lead to more colloquial verbal maltreatment, making reference to the mentioned attributes. Organizational justice Hilary, (2012) makes a firm argument with reference to sexual partiality by calling it differences in human capital investment and stresses upon the need for organizational justice to overcome the peril of glass ceiling / sexual partiality. Debate continues to swirl, not only around the size of the gap, but around whether the gap is unfair or fair: whether it reflects discrimination visited on women or simply differences in human capital investments that women and men bring to the workplace. In this debate, there is a concern, implicitly grounded in the tenets of an equity-based approach to distributive justice, with finding the correct, gender-neutral way to measure equal units of input from women and men so we can fairly assess whether their outcomes (in terms of pay) are equivalent. With reference to other literature available on the subject, similar notions are proposed in addressing the issues related to effective tanning, conducive working environment, equilibrate grant of privileges / rewards, creation of opportunities for future growth, and equality on the basis of performance and capability. HYPOTHESIS Following hypothesis is proposed for this study: H1: Sexism is directly associated with employees efficiency / productivity. H2: Gender partiality during induction is adversely related to the employees productivity. H3: Sexual partiality in promotion is adversely proportional to efficiency / productivity of the employee. H4: Personality and age of the employee, and societal tendency have negative influence on employees efficiency through gender discrimination. H5: Employees productivity is positively affected by his / her professional ability and motivation. The selection of variables is influenced by the past research studies. The analysis are applied on both independent and dependent types of variables; gender discrimination being the independent variable, whereas, Productivity is the dependent variable. Employees of the organization (Mobilink GSM) serve as the unit of analysis. Data Collection Method: In order to execute a more austere test of the proposed model, data has been acquired from diversified respondents through questionnaire. A personally supervised questionnaire has been employed for data collection. Sample: The questionnaire has been personally administered through the concerned people. Out of a total of 360 distributed questionnaires, 300 questionnaires have been received back, resulting into a response rate of 83%. The prime reason for engaging both men and women as respondents is to ensure elimination of biased responses. Descriptive analysis has been performed to present various impression of the respondents i.e., how they respond to the questions. Correlation co-efficient illustrates the firmness of relationship between the variables. The results of this study establish a linear relationship between efficiency / productivity and gender partiality. Regression analysis has been used to ascertain the cause affect relationship between the employees efficiency / productivity and gender discrimination. It is observed that the employees performance and productivity (dependent variable) is highly significant but negatively associated with gender partiality in hiring and gender bias in rewards and promotion. The results of the study present significant impact of the variables on employees performance and productivity. Findings of the study The results of the study justify the tested hypothesis. They establish that gender partiality is directly associated with employees efficiency / productivity (H1). Besides, gender biasness during induction and promotion adversely affects the employees efficiency and productivity (H2 and H3). The research also identifies personality and age of the employee as vital indicators of sexism (H4). However, qualification, professional ability, and motivation are suggested as the significant indicators of employees efficiency, subjected to the organizational justice (H5). Limitations of the study The quantitative method of data acquisition is considered as one of the limitations of this research since it eliminates the element of subjectivity, which is essential to cover diversified aspects and varied off-shoots through detailed responses. Therefore, future researches are encouraged to simultaneously employ both quantitative and qualitative methods of data collection for ensuring improved results with reference to this vast domain of gender discrimination vis-à  -vis employees productivity. Secondly, the study targeted employees of Mobilink GSM deployed at Islamabad and Peshawar regions as the unit of analysis. Thus, restricting the responses to comparatively non-diversified target population. This was because of the inaccessibility to locations like Karachi and Islamabad. For improved results, future work may incorporate responses from such demographically diversified locations. Conclusions The term Employee does not contain illustration of the gender (male / female). Therefore, partiality on the basis of gender must be considered as an illicit practice at all levels. Besides other factors, organizational output is primarily ascribed to the efficiency and productivity of the workforce. The study in hand clearly portrays the decline in altruistic trends and reclines in selfless behavior of the employees, if dealt with sexism / gender partiality. Therefore, it is of paramount importance for all tears of management to ensure gender equality in recruitment, rewards and promotions, and facilitations. This will surely help them acquiring and retaining the best available human resource to ensure enhanced organizational productivity. It will however, be subjected to the presence of organizational justice and equality. The study, culminating on establishing the dire need for implementation and execution of organizational justice, hence promotes further exploration pertaining to the concept of organizational justice.
